Terms and conditions

1. Prices and fees

The prices listed in the order are fixed prices, which may change as a result of services ordered retrospectively or additionally. Price changes only occur in exceptional cases and only if they have been discussed with you in advance and approved by you. We always stick to our fixed price promise.

2. Payment of costs

The client undertakes to cover the total cost of the funeral.

3. Complaints

Complaints due to obvious defects in the coffin, equipment, clothing of the deceased, urn or flower decoration can only be considered if the client reports them within one week after the burial or cremation of the coffin or the burial of the urn.

4. Liability

We are liable in accordance with legal provisions if the client asserts claims for damages based on intent or gross negligence, including intent or gross negligence on the part of our vicarious agents. Insofar as we are not accused of an intentional breach of contract, liability is limited to the foreseeable, typically occurring damage. This limitation also applies if we culpably breach an essential contractual obligation. In addition, our liability for compensation is excluded.

5. Payment terms

Our funeral bill is due 14 days after the date of the invoice and is payable in full, unless another payment date has been agreed.

6. Contract termination

If the client terminates the contract or if it is made impossible for us to carry out the funeral for a reason for which the client is responsible, we are entitled to demand the agreed remuneration, but with deduction of the expenses saved as a result of the cancellation of the contract or the purchase achieved through other use of our labor. Alternatively, we can charge a lump sum of 20% of the contract amount (minus third-party funds). We reserve the right to make further claims.

7. Offsetting

Offsetting against our invoice claims is excluded, unless these are undisputed or legally established claims.

8. Debt collection

When collecting assigned death benefits or other claims against insurance companies and third parties, we act exclusively on behalf of, at the expense and risk of the client.

9. Subsequent payment obligation

Should there be no claim for payment of insurance sums or other benefits in whole or in part, the client must repay the missing amount immediately upon our request.

10. Additional costs

If additional costs arise in carrying out the funeral for important reasons, the client must bear these, provided that they are reasonable for him, taking into account our interests.

10.1. Misrides

Kommt es zu einer Fehlfahrt, die nicht von uns zu vertreten ist, behalten wir uns vor, die dadurch entstandenen Kosten pauschal mit 400 € brutto in Rechnung zu stellen. Eine Fehlfahrt liegt insbesondere dann vor, wenn eine geplante Abholung nicht durchgeführt werden kann – etwa weil uns wichtige Informationen (z. B. eine geplante Obduktion oder starkes Übergewicht) nicht rechtzeitig mitgeteilt wurden, erforderliche Dokumente nicht bereitliegen oder die für die Abholung notwendigen Papiere im Krankenhaus bzw. bei der abgebenden Stelle nicht fertiggestellt sind. Dies gilt unabhängig davon, welche Auskunft uns zuvor durch das Krankenhaus oder sonstige Dritte erteilt wurde.

10.2. Weight and plus size

If the deceased person has a body weight of 100 kg or more and/or a height of 1.90 m or more, we reserve the right to charge an additional fee. The additional charge results from increased organizational, personnel or technical expenses (e.g. special equipment, additional personnel or special crematorium requirements) and can amount to up to 500€ gross, depending on the location and requirements of the respective crematorium.

12. rides

Rides to or from the cemetery or crematorium in funeral vehicles and all other transportation by the client, mourners or third parties are carried out at your own risk. The client is obliged to inform the passengers of this before starting the journey.
